1. Any software that you may download from this site ("Downloaded Software") is the copyrighted work of Infortrend Technology, Inc. ("Infortrend") and/or its licensors.
2. The following terms apply to your use of Downloaded Software.
• Infortrend hereby grants to you a non-exclusive, non-transferable, non-sublicensable, limited license to use the object code version of the Downloaded Software solely on Infortrend products;
• Downloaded Software is provided strictly on an "as-is" basis, without any warranties of any kind, whether expressed or implied, including without limitation any warranties of merchantability, fitness for a particular purpose or non-infringement;
• To the maximum extent permitted by applicable law, in no event will Infortrend be liable for any damages whatsoever, including without limitation damages for any special, consequential or incidental damages, arising out of the use or inability to use the Downloaded Software, or the incompatibility of the Downloaded Software with any hardware or software usage, even if Infortrend has been advised of the possibility of such damages;
• You assume the entire cost of any damage resulting from your use of the Downloaded Software and the interaction (or failure to interact properly) with any other hardware or software whether provided by Infortrend or a third party; and
• Your license to use the Downloaded Software will terminate automatically and without notice in the event that you violate any of these license terms.
3. You agree to indemnify and hold Infortrend, its officers, agents, advisors, directors, employees and consultants, harmless from and against any and all claims, causes, actions, damages or penalties arising out of your breach of your obligations under this Agreement.
4. The Downloaded Software is specifically designed for the use of non-US customers and is strictly prohibited being installed or used in any products that are now or subsequently to be used in or sold, imported or shipped to the United States.
