THE FOLLOWING TERMS AND CONDITIONS. BY DOWNLOADING ANY FILES FROM INFORTREND,
YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO
THESE TERMS AND CONDITIONS, DO NOT DOWNLOAD ANY FILES.
- All Infortrend
products,
including the product you have purchased from Infortrend,
shall be subject to the latest Standard Warranty Policy available on the
Infortrend website: http://www.infortrend.com/global/Support/Warranty
- Any file that
you may download from this site ("Downloadable Files") is the
copyrighted work of Infortrend Technology, Inc. ("Infortrend")
and/or its licensors.
- The following
terms apply to your use of Downloadable File.
- Infortrend
hereby grants to you a non-exclusive, non-transferable,
non-sublicensable, limited license to use the object code version of the
Downloadable File solely on Infortrend products;
- Downloadable
File is provided strictly on an "as-is" basis, without any
warranties of any kind, whether expressed or implied, including without
limitation any warranties of merchantability, fitness for a particular
purpose or non-infringement;
- To the maximum
extent permitted by applicable law, in no event will Infortrend be liable
for any damages whatsoever, including without limitation damages for any
special, consequential or incidental damages, arising out of the use or
inability to use the Downloadable File, or the incompatibility of the
Downloadable File with any hardware or software usage, even if Infortrend
has been advised of the possibility of such damages;
- You assume the
entire cost of any damage resulting from your use of the Downloadable File
and the interaction (or failure to interact properly) with any other
hardware or software whether provided by Infortrend or a third party; and
- Your license to
use the Downloadable File will terminate automatically and without notice
in the event that you violate any of these terms.
- Infortrend may
from time to time modify, update or upgrade the Downloadable File or any
accompanying user documentation without any prior notice. Infortrend will
provide access to these new software releases from the download section of
our website or through our service partners.
- You shall be
responsible for maintaining updated version
of the Downloadable File by downloading or obtaining from
Infortrend, and installing designated updated code, including but not
limited to firmware, microcode, basic input/out system code, utility
programs, device drivers, and diagnostics delivered with Infortrend
product.
- Infortrend shall
NOT be responsible for any interoperability or compatibility issues that
may arise when (1) products, software, or options not certified and supported
by Infortrend are used; (2) configurations not certified and supported by
Infortrend are used; (3) parts intended for one system are installed in
another system of different make or model.
- You agree to
indemnify and hold Infortrend, its officers, agents, advisors, directors,
employees and consultants, harmless from and against any and all claims,
causes, actions, damages or penalties arising out of your breach of your
obligations under this Agreement.
